Delivery, Refunds, Cancellations, and Returns
Please be aware that currently items from my shop are only shipping to England, Scotland, and Wales.
Items will normally be sent via Royal Mail unless the order is over the weight limit in which case it will be sent by courier. Please be aware that if it becomes necessary a different delivery company may be used.
While every effort is taken to deliver your item on time, I cannot be held responsible for any delays from the mail or courier service as these are out of my control.
Most of the items in my shop are shipped directly from my manufacturer, usually within 2-3 weeks, however if you need any assistance please contact me, Tamzin Cavendish, via help@rusticusmus.co.uk
Orders will be delivered to the address submitted by the buyer on the order form in the website.
Once delivered, the buyer will be the owner of the item and therefore responsible for any loss or damage.
A buyer must refuse to take delivery of the item if damage is evident on arrival.
If a buyer refuses to take delivery of the item for any reason other than evident damage, then expenses incurred by the seller for delivery and return of the item will be deducted from any refund.
The maximum delivery time is 30 days. In the event that the maximum time is exceeded I will contact the buyer.
Returns & Cancelations
Under UK distance selling laws, you have up to 14 calendar days after the delivery date shown on carrier tracking to cancel your order for any reason.
To do this, please email me via help@rusticusmus.co.uk and we can arrange the return of the item (in it’s original packaging) and a full refund. The buyer must pay the postal costs or returning the item.
If the item is returned in a damaged condition a deduction may be made from your refund to cover this.
Customers must report any defects, damage, or incorrect items within 14 calendar days of the delivery date shown on carrier tracking.
To process any defect or damage claim, customers must submit to help@rusticusmus.co.uk :
– Order number
– Clear photo of the full product showing the issue
– Close-up photo of the specific defect
– Photo of the product tag showing size and product details
– Photo of the shipping label on the packaging
Claims without full photographic evidence will not be processed.
Your right of withdrawal does not apply under EU Consumer Rights Directive Article 16(c) or Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Regulation 28(1)(b) on any item made to your specification or personalised items.

Definitions
– “Buyer” means the person who buys goods from the seller.

– “Terms and Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
Payment
• England/Scotland/Wales customers can pay by debit/credit card and Paypal.
• Delivery will only occur after full payment has been received and cleared.
Availability
• All items are subject to availability and is sold on a first come first served basis.
• In the unlikely event that an item becomes unavailable after the purchase process has been completed, the unsuccessful buyer will be informed by email and a full refund will be issued.
• The seller reserves the right to cancel any order. Should this occur a full refund would be issued.
Prices
• The price and description of the item is valid at the time of order. Any subsequent changes will not affect the order.
Force Majeure
• The seller or the buyer shall not be liable for any delay or failure to perform any of their obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply and they shall be entitled to a reasonable extension of their obligations.
Copyright
• All copyright for items are and will remain the property of the seller. Any infringement on these rights will be pursued vigorously.
• The copyright for all original paintings and prints remains with the artist/seller; the buyer is purchasing the original or print NOT the right to produce prints for publication.
• If publication rights are required by a commercial buyer, they must contact the seller by email or telephone for a separate list of prices, terms & conditions. The seller will deal with each commercial buyer on an individual basis.
• The artist, Tamzin Cavendish a.k.a. Rusticus Mus, has the right to reproduce any of her original paintings.
Miscellaneous
• The seller reserves the right to amend these Terms and Conditions at any time.
• The seller reserves the right to make changes to the product information and prices without prior notice.
• These Terms and Conditions do not affect consumer statutory rights.
• All care and attention is taken to ensure full accuracy in documenting product size and colour, however small deviations may occur.
• There may be some colour variations on reproduced artwork.
